OSHA standards are very clear about workers’ rights.¬†Employers are charged with maintaining accurate documentation which may seem like common sense. What can be more confusing is making sure employees are classified under the right worker status.

In 2016, a
publicized case¬†against a Connecticut construction company revealed a fine over $20,000 due to the misclassification of employees as independent contractors. In this case, the administrative law judge (ALJ) found that “the company provided tools and equipment, had control over worksite safety, determined when and how the workers worked and paid hourly wages to the individuals.”

Employers should be advised that efforts to evade responsibility for job site safety may result in citations, legal action and fines. Ignorance of these laws is no excuse. OSHA provides clearly outlined policies, but truly understanding how to implement OSHA regulations can sometimes feel overwhelming for any HR department.
